1. 服务与资格
Inking 提供手写日记、AI 回信、连续记忆、账户同步以及可选的 App Store 内购买功能。你必须达到所在地可独立同意使用数字服务的年龄；否则应由父母或法定监护人阅读并同意本条款。
2. AI 回信的性质
你应根据自己的情况独立判断回信内容。若你或他人面临现实中的紧急危险、自伤风险或医疗危机，请立即联系所在地的紧急服务、危机热线或可信任的人，而不要依赖 Inking。
3. 你的内容
你保留自己日记内容的权利。为了运营 Inking，你授予我们一项有限的、非独占的许可，仅用于接收、存储、处理、生成回信、同步、恢复、保护和改进你所使用的服务。该许可受我们的隐私政策约束，并在相关内容删除后终止，但法律要求保留、交易与安全记录或正常备份轮换除外。
你应确保有权提交相关内容，不得上传侵犯他人权利、违法、恶意或旨在破坏服务的内容。
4. 账户与设备
- Inking 可以先以设备日记使用；“通过 Apple 登录”用于在符合条件时关联、恢复或同步账户。
- 你应保护自己的设备、Apple 账户与日记编号，不得转让用于鉴权的密钥或令牌。
- 退出账户可能在当前设备上开始一本新的匿名日记，并不等于删除原账户。
- 若你怀疑账户被未经授权使用，请及时联系我们。
5. 墨水、购买与订阅
- “墨水”是 Inking 内用于获得回信或相关功能的数字使用额度，不是货币，无现金价值，不可在应用外转让或兑换。
- 一次性墨水和自动续订订阅均通过 Apple App Store 销售。价格、周期、每期额度、试用或促销条件以购买确认页面和 App Store 显示为准。
- 订阅由 Apple 按购买页面显示的周期自动续订并收费，除非你在 Apple 账户的订阅设置中取消。删除 App 或 Inking 账户不会自动取消 Apple 订阅。
- 恢复购买用于同步符合条件的交易或有效订阅；消耗型额度是否可恢复取决于 Apple 交易状态和服务端已交付记录。
- 付款、账单、取消和退款由 Apple 及适用的 App Store 规则处理。法定消费者权利不受本条款限制。
- 为防止重复入账、欺诈和争议，我们可以核验并保留必要交易记录，并纠正因错误、退款、撤销或重复交付产生的余额。
6. 可接受使用
你不得：
- 绕过安全、购买、配额、App Attest 或访问控制；
- 以自动化、高频或欺诈方式滥用服务，干扰他人或基础设施；
- 反向工程服务端、探测漏洞，或传播恶意代码，但适用法律明确允许的行为除外；
- 利用 Inking 生成、保存或传播违法、侵权或严重危害他人的内容。
7. 服务变更、限制与终止
我们可能为维护、安全、法律合规或产品改进而修改、暂停或停止部分功能。若账户存在欺诈、滥用、安全风险或严重违反本条款的行为，我们可以限制访问。我们会在合理可行时提供通知，并依法处理已购买权益。
你可以停止使用服务或在 App 内发起删除账户。存在有效订阅或购买历史时，请同时在 Apple 账户中管理订阅，并按支持页面说明联系我们处理无法自动完成的删除。
8. 知识产权
除你的内容外，Inking 的软件、界面、品牌、文字、图形和服务设计由我们或相应权利人拥有。除法律允许或我们书面同意外，不得复制、出售、出租、重新发布或创建实质性衍生产品。
9. 免责声明与责任限制
在适用法律允许的最大范围内，服务按“现状”和“可用”状态提供。我们不保证 AI 回信始终准确、服务永不中断、数据永不丢失或所有功能始终可用。你应为重要内容保留适当备份。
在适用法律允许的最大范围内，我们不对间接、附带、特殊或后果性损失负责。本条款不排除或限制因故意不当行为、重大过失、人身伤害而依法不得排除的责任，也不影响你依法享有的强制性消费者权利。
10. 条款变更与争议
我们可能因产品、法律或安全变化更新本条款，并会为重大变化提供适当通知。更新后继续使用即表示接受新条款；若你不同意，可停止使用。
本条款适用运营者所在地的法律，但不会剥夺你所在地法律赋予的强制性消费者保护。发生争议时，请先联系我们尝试善意解决；无法解决的，可提交具有管辖权的法院或适用的消费者争议机构。

1. Service and eligibility
Inking provides handwritten journaling, AI-generated replies, continuous memory, account synchronization, and optional App Store purchases. You must be old enough to consent to a digital service where you live; otherwise, a parent or legal guardian must review and agree to these Terms.
2. Nature of AI replies
Use your own judgment based on your circumstances. If you or someone else faces immediate danger, self-harm risk, or a medical emergency, contact local emergency services, a crisis line, or a trusted person instead of relying on Inking.
3. Your content
You retain your rights in your diary content. To operate Inking, you grant us a limited, non-exclusive license only to receive, store, process, generate replies from, synchronize, restore, protect, and improve the service you use. This license is subject to our Privacy Policy and ends when the relevant content is deleted, except for legally required records, transaction and security records, and normal backup rotation.
You must have the right to submit your content. Do not submit content that violates others’ rights, breaks the law, is malicious, or is intended to damage the service.
4. Accounts and devices
- Inking can begin as a device-based diary. Sign in with Apple can link, restore, or synchronize an eligible account.
- Protect your device, Apple account, and diary code. Do not transfer authentication keys or tokens.
- Signing out may begin a new anonymous diary on the current device; it does not delete the original account.
- Contact us promptly if you suspect unauthorized account use.
5. Ink, purchases, and subscriptions
- “Ink” is a digital usage credit for replies or related Inking features. It is not currency, has no cash value, and cannot be transferred or redeemed outside the app.
- One-time ink and auto-renewing subscriptions are sold through the Apple App Store. The purchase confirmation screen and App Store listing control the price, term, credits per period, trial, and promotion details.
- Apple renews and charges subscriptions for the period shown at purchase unless you cancel in your Apple account’s subscription settings. Deleting the app or your Inking account does not cancel an Apple subscription.
- Restore Purchases synchronizes eligible transactions or active subscriptions. Whether consumed credits can be restored depends on Apple’s transaction status and server delivery records.
- Apple and the applicable App Store rules handle payment, billing, cancellation, and refund requests. These Terms do not limit mandatory consumer rights.
- To prevent duplicate credit, fraud, and disputes, we may verify and retain necessary transaction records and correct balances affected by errors, refunds, reversals, or duplicate delivery.
6. Acceptable use
You must not:
- Circumvent security, purchase, quota, App Attest, or access controls;
- Abuse the service through automated, excessive, or fraudulent traffic, or disrupt other users or infrastructure;
- Reverse engineer server-side services, probe vulnerabilities, or distribute malicious code, except where applicable law expressly permits it; or
- Use Inking to generate, store, or distribute unlawful, infringing, or seriously harmful content.
7. Changes, restrictions, and termination
We may modify, suspend, or discontinue features for maintenance, security, legal compliance, or product improvement. We may restrict an account involved in fraud, abuse, security risk, or a serious violation of these Terms. Where reasonably practical, we will provide notice and will handle purchased entitlements as required by law.
You may stop using the service or start account deletion in the app. If you have an active subscription or purchase history, also manage the subscription in your Apple account and follow the Support page for deletion that cannot complete automatically.
8. Intellectual property
Except for your content, Inking’s software, interface, branding, copy, graphics, and service design are owned by us or their respective rights holders. You may not copy, sell, rent, republish, or create substantially derivative products except as allowed by law or with our written permission.
9. Disclaimers and limits of liability
To the fullest extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee that AI replies are always accurate, the service is uninterrupted, data is never lost, or every feature remains available. Keep appropriate backups of important content.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses. Nothing here excludes liability that cannot legally be excluded, including for intentional misconduct, gross negligence, or personal injury, or limits mandatory consumer rights.
10. Changes to these Terms and disputes
We may update these Terms when the product, law, or security needs change and will give appropriate notice of material changes. Continuing to use Inking after an update means you accept the revised Terms; if you do not agree, stop using the service.
These Terms are governed by the laws applicable where the operator is established, without depriving you of mandatory consumer protection where you live. Please contact us first to try to resolve a dispute in good faith. Unresolved disputes may be brought before a court with jurisdiction or an applicable consumer-dispute body.
